Message from the City Marshal
Welcome to the City Marshal's web page. Our mission is to ensure that all ordinances passed by the City Council are implemented and enforced fairly and equitably through code compliance investigations, administrative permitting and licensing, inspections, collections, and regulatory procedures. Citizens are encouraged to report code violations by phone, email, or in person to any member of the City Marshal's Office. We can also assist you with most licenses or regulatory permits required by the City Ordinances.

The City Marshal's office issues citations and is responsible for
ordinance enforcement, business permit processing, and business
and occupation tax administration.

The following is an overview of the process necessary
for obtaining an Occupation Tax certificate:*

Businesses which will be operating from
a commercial location should first obtain a Zoning Verification
from the Planning and Zoning Department, which is located at
430 Prior Street. The next step is just down the hall at the
Building Inspection Department. Your Zoning Verification should
be presented here as you apply for a Certification of Occupancy.
Once you have obtained your Certificate of Occupancy (C.O.),
you should bring that document to the City Marshal's Office
which is located in Room 103 of the Gainesville/Hall County
Joint Administration Building next door to City Hall. Here you
will complete a two-page form, which requires basic identifying
information about your business. This normally takes about 10-15
minutes. Upon receipt of this form and proper payment, based
upon the tax table above, your application process will be complete.

Businesses that will be operating from
a residence should also go to the Planning and Zoning Department
for a determination as to what steps are necessary for obtaining
the proper approval for operating a business from your home.
This essentially is determined by the type of business and location.
You may qualify as a Home Office. If so, you will receive a
copy of a Home Office Affidavit which you would then bring to
the City Marshal's Office in Room 103 of the Joint Administration
Building where you will fill out the form for your Business/Occupation
Tax, submit the form with the proper payment and your application
process will be complete. If you do not qualify as a Home Office,
the personnel in the Planning and Zoning Department will explain
to you the steps, which you should follow. |
*There are exceptions to these procedures for certain businesses,
which require special licenses.

and collect fees for various functions including:

| Sidewalk Sales |
Collect license fees and maintain records on:
| Insurance Companies |
| Bingo |
| Depository Financial Institutions |
| Enforce all sections of the City Code through
cooperation and coordination with other City Departments. |
| Investigate and take appropriate action,
including citations and abatement, on complaints from the public
or other departments. |
| Collect fees due the City for abatement
procedures. |
| Collect and maintain records on Hotel/Motel
Tax. |
| Conduct Marshal Sales pursuant to tax executions. |
| Assist Finance Department with City surplus
sales. |
| Dispose of abandoned vehicles by obtaining
court orders and selling unclaimed vehicles at public auction. |
